CANCELLATION POLICY

Classes

  • Cancellation for class packs received more than 3 hours before your booked class starts is allowed with no penalties. This allows waitlist students to be contacted and invited to the class. A new class can be booked in place of the cancelled class but payments are not refundable.

  • Late Cancellation, within 3 hours of the start of the booked class, or a ‘No Show’ (failure to turn up for a class at all) will incur the following:  Class Pack Students: Will result in the deduction of the class from your pass. Contracted members: must cancel up to 1 hour before class time to avoid being fined £5 as stated on contract.

  • Please remember that you must go to our online booking system and remove yourself from the class list if you cannot attend a class.

 

Workshops and Beginners Courses
 

  • You may cancel any booking for a course or workshop if you give us 14 days or more notice of cancellation before its start date, although we will charge you an administration fee to process your cancellation. This administration fee is £5 where the cost of the course or workshop is less than £50 and is £10 where the cost is £50 or more.

  • If you wish to cancel within 14 days of the start date there will be no refund unless there is a waiting list for the event and we can transfer your booking to another applicant. Only the administration fee as above will be payable if we succeed in transferring your booking to someone else.

  • You may transfer your booking to someone else, but we ask that you let us know so that the substitute's name appears on the sign-in lists. Please do this by e-mailing info@breezeyoga.co.uk

  • We reserve the right to cancel a course or workshop in the event of exceptional circumstances that means we are unable to offer the event as advertised or if there are insufficient numbers booked into the event for it to be commercially viable. Should this happen you will be given a full refund of fees you have paid.

 

Retail Products

  • Products returned in re-saleable condition can be exchanged within 2 weeks from date of purchase, or refunded to Breeze account only (no monetary refunds allowed)

  • Any products returned as ‘faulty’ should be returned with reason/evidence of fault, and we will return to manufacturer, and will report back to customer. No refund/replacement to be given to customer until fully investigated.

  • Any skin/body products returned must have evidence/photographic evidence of fault/reason for return, and it will then be returned to manufacturer for review and result reported back to customer.  No replacement/refund to be given to customer until fully investigated.

          

No refunds will be given for Gift Vouchers

PRIVACY POLICY

 

Breeze Yoga Limited is committed to ensuring any data provided by you the user is used only in such a way as you would like and will be fully compliant with all legal requirements relating to such issues. 

In order to provide you with the full range of services, we are sometimes required to collect information about you.

This privacy policy explains the following:

  • what information we may collect about you;

  • how we will use information we collect about you;

  • when we will use your details to contact you;

  • whether we will disclose your details to anyone else;

  • your choices regarding the personal information you have provided to us;

As set out above, Breeze Yoga Limited is committed to safeguarding your personal information. Whenever you provide such information, we are legally obliged to use your information in line with all laws concerning the protection of personal information in line with the General Data Protection Regulations 2018 (GDPR).

1. WHAT INFORMATION WILL BREEZE YOGA LIMITED COLLECT ABOUT ME?

When you sign up to participate in or receive a service from Breeze Yoga such as newsletters, details of offers etc., we may ask for personal information about you. This can consist of information such as your name, e-mail address, postal address, telephone or mobile number or date of birth.

When you participate in our classes and workshops we are required to request medical information about you to ensure that you are able to participate in our classes.

Should you choose to enter into a membership contract at Breeze we will require you to provide your financial information such as bank details and or card details. 

We will request to obtain details of a next of kin contact for use in the event of an emergency.

Your information is stored safely and securely and will not be passed to any 3rd party service provider.

2. HOW WILL BREEZE YOGA LIMITED USE THE INFORMATION THEY COLLECT ABOUT ME?

The club will use your information for the following purposes:

  • for "service administration purposes", i.e. to respond to the request or service that you have requested.

  • to contact you about a submission you have made to the website.

  • to process payments relating to our services.

  • to keep your medical details on file for reference.

  • to analyse and improve the services offered by the studio.

3. DO WE SHARE INFORMATION?

We do not sell your personal information to others. We only share your information with software provider (MINDBODY Inc and Mindbody Online in the USA). Our website contains links to other businesses’ and if you choose to select these links then they may collect information. Such sites are not within our control and are not covered by this privacy statement. If we believe that your use of the site is unlawful or damaging to others, we reserve the right to disclose the information we have obtained through the site about you to the extent that it is reasonably necessary in our opinion to prevent, remedy or take action in relation to such conduct.

4. WHEN WILL BREEZE YOGA LIMITED CONTACT ME?

We may contact you:

  • to assist you with further information in relation to any areas you have expressed an interest in.

  • where you have opted to receive further correspondence.

  • to inform you of any change to our services

  • to update any information you have provided such as expired methods of payment

5. WILL I BE CONTACTED FOR MARKETING PURPOSES?

We may contact you in relation to special offers at Breeze from time to time unless you have notified us that you do not wish us to.

6. HOW LONG WILL BREEZE YOGA LIMITED KEEP MY PERSONAL INFORMATION?

We will hold your personal information on our systems and will discard of automatically and safely should you cease to be a customer of Breeze.

7. CAN I FIND OUT WHAT PERSONAL INFORMATION BREEZE YOGA LIMITED HOLDS ABOUT ME?

Under the Data Protection Act you have the right to request a copy of the personal information the club holds about you and to have any inaccuracies corrected. (We charge £10 for information requests and will require you to prove your identity with 2 pieces of approved photographic identification.) We will use reasonable efforts to supply, correct or delete personal information about you on our files. Please address requests and questions about this direct to the studio.

8. CHANGES TO THE BREEZE YOGA LIMITED PRIVACY POLICY

This privacy policy may be updated from time to time.

9. COOKIES

Like most other websites, during the course of any visit to the Breeze website, we may use small files which are stored on your hard drive by your browser (“cookies”) to monitor your use of our website. Once you have closed your browser, we do not use the information these cookies collect.

10. SECURITY

All personal and credit card information is encoded using 256-bit Secure Sockets Layer (SSL) data encryption before being sent over the Internet. To protect your data further, your credit card information is always stored in encrypted form in a database that is separate from our website database, so it isn’t connected to the Internet. Credit card transactions are issued a digital certificate, ensuring that your data can only be read by our transaction system as long as your browser shows its secure mode symbol (such as a key or closed lock). To make the most of the security on our site, we recommend using a modern browser such as Firefox that enables SSL. We also recommend setting your browser’s preferences to accept cookies and enable JavaScript.

TERMS & CONDITIONS

 

1    STUDIO OPENING TIMES

1.1  Studio opening times and class times at the Studio may vary from time to time. Opening times and class times will be published by the Studio on our Website.

1.2  Off-peak hours are from 8am to 6pm Monday to Friday. Yoga and Pilates classes which commence during these hours are considered to be off-peak classes.

2    YOGA AND PILATES CLASSES

2.1  Drop-in Classes

  • Class prices are available on our Website and will be reviewed by the Studio from time to time.

  • Payment is required prior to attendance.

  • The payment for a drop-in class is non-refundable, but if a Client cancels within the required cancellation window the class will be refunded to their Client account to be used within a month.

2.2  Introductory Offers (£40 for 20 days trial and £60 for 14 days Returners trial)

  • The 20 days for £40 trial offer is only available if the customer has never had any previous introductory offer at Breeze.

  • The Returners trial can be redeemed once and is only available to customers returning to Breeze after an absence of 1 or more years.

2.3  Class Packs

  • Class Packs can be purchased via the Breeze Yoga Limited website or in person at Breeze reception.

  • Price details for Class Packs are available to view on our Website or at Breeze and such prices shall be determined by us from time to time.

  • Credits purchased as part of bundles have varying expiry dates so please carefully check the expiry date on the bundle you are buying at time of purchase.

  • Class Pack bundles purchased online, will activate from the first visit to Breeze following the purchase.

  • Should you wish to extend your Class Packs expiry date by 30 days you will need to contact Breeze reception. Please note that an administration charge of £10 applies for all extensions.

  • Should you wish to suspend your Class Packs package on medical grounds you will need to contact Breeze by email on info@breezeyoga.co.uk

  • Class Packs are not transferable to any other person.

  • Subject to any statutory right of cancellation (i.e. in the rare instance of us having to cancel a class for any reason), payments for Class Packs are non-refundable.

2.4  Memberships

  • The Studio provides 4 types of membership: BY Peak Membership, BY Off Peak Membership and BY Concession/Partner Membership.

MEMBERSHIP

  • In the terms and conditions the following definitions apply: “Company” means Breeze Yoga Limited. “Studio” means the premises of Breeze Yoga Limited at 9 Albemarle Road, Beckenham, Kent, BR3 5HZ. “Member” means any person that has signed a Membership Agreement which has been accepted by the company. “Terms and Conditions” means these terms and conditions. “Minimum Subscription Period” is 12 months (known as the “initial term”).

  • The Company reserves the right to vary and revoke the Terms and Conditions from time to time which it may deem necessary or desirable for the regulation of internal affairs of the Studio and the conduct of the Members. Any such changes will be notified to Members by means seen appropriate by the Company. Until revoked these are binding on Members.

  • The Terms and Conditions shall be governed by the laws of England and are subject to the exclusive jurisdiction of the English courts.

  • When a person has signed a Membership Agreement he or she shall become a Member of the Studio.

  • Acceptance of a person as a Member is at the absolute discretion of the Company.

  • The Company reserves the right to expel from the Studio, suspend for a specific period of time or refuse to renew the membership of any Member of the Studio for any reason in which the Company deems reasonable. Any Member so expelled shall forfeit all privileges to the Studio membership and shall not be entitled to any refund for any period during which his or hers membership is suspended.

MEMBERS' TERMS OF MEMBERSHIP

  • To qualify for the discounted monthly rate the Member must provide the Company with credit or debit card details and agree to a minimum of 12 months membership. The initial monthly payment is taken when signing up for the Membership with subsequent monthly payments taken out on the billing date of your contract on the card supplied. Membership fees remain payable whether or not the Client uses the Studio’s facilities.

  • After the Minimum Subscription Period, the Membership will automatically be renewed for subsequent months, until cancelled by either the Member or Breeze Yoga Limited.

  • You can end your Membership at the end of your Minimum Subscription Period by giving us at least one calendar month’s notice in writing. The notice period will begin from the first of the month after we have received your notice.

  • The Member agrees and acknowledges that by agreeing to the Minimum Subscription Period, they are being given preferential rates by the Company and therefore it is fair and reasonable that the Company charges them for any payments as referred to above.

  • The Company reserves the right to increase membership rates in January each year by giving one month notice to Members.

AUTOMATED PAYMENT TERMS

  • For those Members who wish to pay the Membership fees monthly an automated payment system must be used.

  • Monthly fees apply irrespective of whether or not the Member uses the Studio's facilities.

SUSPENSIONS

  • The acceptance of this request is entirely at the discretion of the General Manager of the Studio.

  • The Member may, at the discretion of the Manager, suspend their membership for a period of one calendar month, once, in any 12 month period. The Minimum Subscription period will be extended by one month if such a suspension is agreed to.

  • A suspension will not be permitted for Members who have given notice to cancel or who are in debt to the Company. Periods of suspension can only be granted for complete future calendar months and are not retrospective.

LIMITATION OF LIABILITY

  • Breeze Yoga Limited cannot be held responsible for any service or equipment not being available for whatever reason. Breeze Yoga Limited reserves the right to make alterations to the type of facilities provided, without notice and in its absolute discretion and Breeze Yoga Limited shall not be liable for any loss occasioned by such alterations.

  • It is the Members responsibility to ensure that he or she is capable of undergoing a routine of exercises provided by any programme which he or she follows or class which he or she attends. Members and Guests accept the risk of injury from performing exercises and are advised to consult their doctor prior to beginning any programme or class.

  • The company accepts no liability for loss or damage to property of Members on the Studio’s premises or outside the Studio.

MEMBERSHIP CARDS

  • Membership cards remain the property of the Company and the Company reserves the right to retain any membership card if there has been a defaulted payment by the member concerned.

  • Any member who loses their card may apply for a replacement, for which a replacement fee of £5 will be applicable.

  • The membership card must only be used by the person to whom it is issued.

OPENING TIMES

  • The Company reserves the right to change the Studio’s opening times as it deems necessary.

  • Dress: Members are required to wear appropriate attire at all times when on Studio premises.

GENERAL

  • No crockery, glass or food are permitted inside the Studio.

  • Only water in a sealed container is permitted inside the studios.

  • In the event of a fire, Members are asked to make their way to the nearest available exit.

  • No smoking is allowed within the Studio.

  • Members will be charged for a class where cancellation is not received by the Studio at least 1 hour prior to the class. starting.

2.5  Booking of Classes

  • Classes can be booked on our Website, using Mind Body Connect App or by phone up to 1 week in advance .

  • All customers with online bookings are required to sign into class a minimum of 5 minutes prior to the class start time. If you have not signed in by this time, or called to notify us that you are running late, your space will be opened up to allow drop ins and this will be treated as a ‘Late Cancellation’ (see 2.6 below) and your class will not be credited or refunded.

  • When classes have reached their online booking capacity you can add yourself to the waitlist.

  • If you are on the waitlist for a class you will automatically be allocated a space in the class once a spot becomes available, the Mind Body App will give you a notification.

  • The Breeze team reserve the right to deny entry to any class after the scheduled start time.

3    GIFT VOUCHERS

3.1 Gift certificates/vouchers are valid for one year from date of purchase. These are non-refundable, and cannot be used after the expiry date.

4   DISCOUNTS
​4.1 The Studio is pleased to offer Senior students (+65s) a drop in rate of £10 per class (except for "senior" classes which are £8 - see below). Identification details can be provided online and confirmed at your first visit.

4.2 NHS staff and workers, emergency services, armed forces, full time teachers in main stream education & full time students are entitled to 10% discount on all drop in classes (from Friday-Wednesday) or any class packs. The discount cannot be applied to memberships. Identification details can be provided online and confirmed at your visit.

4.3 Senior students (+65s) pay just £8 to attend our specific Senior classes only (listed below)

Senior classes:

  • Monday 2pm - 3pm Senior Yoga with Elizabeth Knott

  • Tuesday 2 - 3pm Senior Pilates with Mandy Mitchell

  • Thursday 1:15 - 2:15pm Senior Pilates with Domini Winter

4.4 Concession Thursdays - A 50% discount on drop in classes (only) are available to NHS staff and workers, emergency services, armed forces, Equity/Starlight members, full time teachers in main stream education & full time students on all classes, all day, every Thursday - Identification details must be provided on your visit.

4.5  Customers subscribing to the Studio's membership scheme are entitled to following discounts:

  • BY Peak and BY Off Peak members are entitled to 10% off Workshops (not courses).
     

4.6 Discounts and special offers cannot be combined or accumulated. 

 

​5   USE OF FACILITIES

5.1 Customers are entitled to use the Studio’s facilities providing always that the Studio (with notice where practical), may at any time withdraw all or part of its facilities for any period for cleaning, repair, alteration or maintenance work or for any other reasons beyond the control of the Studio or the Company.

5.2 Children under the age of 16 may only use the Studio and attend classes if accompanied by an adult and when under their care and supervision, however the Studio reserves the right of refusal for any minor to practice according to clause 8.

5.3 Children age 7 and over may not enter the changing rooms or other areas reserved for the opposite sex, regardless of whether they are accompanied by an adult.

6    FITNESS AND HEALTH

6.1 Clients are advised not to undertake any strenuous physical activities without first seeking medical advice if they have any concerns over their physical condition. The Studio reserves the right to refuse access to any customer if, in its absolute discretion, it considers that the health of the individual concerned may be endangered by the use of our facilities.

6.2 Clients with the following conditions should not attend class: low/high blood pressure and cardiac irregularities. If there is any doubt, the Client should consult their doctor. Clients and their guests must notify the Studio of any circumstances affecting their health which may be exacerbated through continued use of the Studio.

6.3 Clients are required to follow the instructions of the teacher or therapist at all times.

7  DRESS AND FOOTWEAR

7.1 Clients are requested to wear a form of dress appropriate to the practice of Yoga or Pilates. Footwear should be removed before entering either of the studios and left in the changing rooms or the footwear racks provided.

 

8    HEALTH AND SAFETY

8.1  Smoking is not permitted anywhere on the premises.

8.2  No crockery, glass or food is permitted in the changing rooms or in the studios. Only water in plastic bottles is permitted in the Studio.

8.3  Fire exits, which are clearly marked, are there in the interests of safety and customers must not interfere with these doors for any reason.

8.4  In the event of a fire, Clients are asked to make their way to the nearest available exit.

9     PERSONAL BELONGINGS

9.1  To create a calm and uncluttered environment our studios are mobile phone,  bag, coat and shoe free zones. Clients are requested to use shoe and coat rack provided, or the lockers in the changing rooms.

9.2  Personal belongings are brought into the Studio premises at the customer’s risk and the Company does not accept liability for any loss or damage whatsoever to such items.

10   GENERAL GUIDELINES

10.1  Customers must at all times observe the Studio guidelines which may be notified to them from time to time and are requested to comply with any reasonable directions which the management of the Studio may  issue to ensure the smooth operation of the Studio for the convenience of all customers.

10.2  Customers are required to give written notice to the Company of any change of address. Failing such notice, all communications shall be assumed to have been received by the customer within 5 days of mailing to the last address notified to the Studio.

10.3  The Management reserves the right to refuse admission to the Studio.

10.4  The Studio may, if a client so wishes, communicate with the client by electronic mail (“email”). By providing an email address to the Studio the client consents to receiving email communications from the Studio, including notices pursuant to the Terms and Conditions. The client also accepts any risk that email may not be a fully secure and confidential means of communication. The Studio will not be liable for any loss or damage suffered as a result of communicating with a client in this manner.

11     LIMITATION OF LIABILITY

11.1  The Studio cannot be held responsible for any service or equipment not being available for whatever reason. The Company reserves the right to make alterations to the types of facilities provided, without notice and in its absolute discretion and the Studio shall not be liable for any loss occasioned by such alterations except in so far as the loss is by law incapable of exclusion.

11.2  It is the customer’s responsibility to ensure that they are capable of the exercises involved in any programme or class they book to attend. Clients accept the risk of injury from performing exercises and are advised to consult their doctor prior to beginning any programme or class.

11.3  The Studio accepts no liability for loss or damage to property or injury of the customers in the business premises or outside the business premises except in so far as such loss, damage, or injury is by law incapable of exclusion.
